1. Acceptance of Terms

Our services include, but are not limited to, epoxy floor coatings, polished concrete, garage floor coatings, polyaspartic coatings, metallic epoxy, concrete grinding, surface preparation, concrete sealing, concrete resurfacing, pool deck coatings, and related concrete flooring work.

All services are performed at the customer's property by our team or authorized subcontractors. We reserve the right to decline any project at our sole discretion.

3. Estimates and Pricing

Written estimates provided by Bradenton Epoxy Flooring & Concrete Polishing are based on conditions observed at the time of the on-site assessment. An estimate is not a guaranteed fixed price. Final pricing may be adjusted if:

• Hidden conditions are discovered during work (such as existing coatings, moisture problems, or structural damage not visible during the initial assessment)
• The scope of work changes at the customer's request
• Material costs change significantly between the estimate date and the project start date

Any changes to the original scope or price will be communicated to the customer and agreed upon in writing before additional work proceeds. Verbal estimates are not binding.

4. Scheduling and Cancellation

Project start dates are scheduled by mutual agreement. We will make reasonable efforts to begin work on the agreed date, but delays may occur due to weather conditions, material availability, or other factors outside our control. We will notify you as promptly as possible if a delay is anticipated.

If you need to cancel or reschedule a confirmed appointment, please notify us as soon as possible. Cancellations with less than 48 hours notice for a scheduled project start date may result in a cancellation fee to cover mobilization costs already incurred. The specific amount, if any, will be stated in your service agreement.

We reserve the right to reschedule or cancel work if site conditions on the day of service are unsuitable for safe or quality installation, such as extreme weather or incomplete customer preparations.

5. Customer Responsibilities

Before work begins, the customer is responsible for:

• Removing all personal property, vehicles, furniture, and stored items from the work area
• Ensuring safe and unobstructed access to the work area for our crew and equipment
• Disclosing any known conditions that could affect the project, such as prior coatings, moisture issues, active leaks, or chemical contamination
• Ensuring pets and children are kept away from the work area during installation and curing

If the work area is not prepared as agreed upon arrival, we may need to reschedule the project. Additional trip or preparation fees may apply.

6. Payment Terms

Payment terms will be outlined in your written estimate or service agreement. In general:

• A deposit may be required to confirm scheduling for larger projects
• Final payment is due upon project completion unless otherwise agreed in writing
• Accepted payment methods will be specified in your service agreement

Overdue balances may be subject to a late fee. If payment is not received within 30 days of the invoice date, we reserve the right to pursue collection through appropriate legal means. In such cases, the customer may also be responsible for reasonable attorney fees and collection costs.

7. Warranty and Workmanship

We stand behind the quality of our work. Any warranty terms specific to a project will be stated in the written service agreement. In general, our workmanship warranty covers defects in installation that appear under normal use conditions within the warranty period.

The warranty does not cover damage resulting from:

• Customer misuse, abuse, or improper maintenance
• Changes in the underlying concrete structure after installation
• Chemical spills not disclosed prior to the estimate
• Natural events including flooding, storms, or seismic activity
• Normal wear and tear beyond the warranty period

Product warranties from material manufacturers are separate from our workmanship warranty and are subject to those manufacturers' own terms.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Bradenton Epoxy Flooring & Concrete Polishing shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to the services we provide or the use of our website, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or related to a service project shall not exceed the total amount you paid us for that specific project.

9. Warranty Disclaimers

Except as expressly stated in a written service agreement, our services are provided "as is" and without any additional warranty, express or implied, including warranties of merchantability or fitness for a particular purpose. We make no guarantee that a specific aesthetic outcome will be achieved beyond what is described in the written scope of work.

10. Dispute Resolution

If a dispute arises between you and Bradenton Epoxy Flooring & Concrete Polishing regarding any service or these terms, we ask that you contact us first so we can work toward a resolution directly. Most issues can be resolved quickly with open communication.

If a resolution cannot be reached, both parties agree to attempt mediation before pursuing litigation. Mediation costs shall be shared equally unless otherwise agreed. If mediation fails, disputes shall be resolved through binding arbitration or in a court of competent jurisdiction in Manatee County, Florida, at our election.

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action or proceeding arising under these terms shall be brought in the courts located in Manatee County, Florida.
